Stone Peak Development Agreement Addendum

The new owners of the Stone Peak Townhomes project are seeking an amendment to the existing development agreement which would allow the sale of townhomes in phases. Driggs Land Development Code currently requires all townhomes in a development to be completed and receive a certificate of occupancy prior to final plat approval. This would require the entire 44 home development to be completed before any could be sold, meaning that many would sit vacant until the others were completed. By adding language to the development agreement, the townhomes could receive final plat approval for individual phases, allowing the developer to sell the units once each building receives its certificate of occupancy.

On August 16, this item was considered by City Council during a public hearing. Ultimately, Council moved to approve the amendment to the Development Agreement, which will be executed by the Mayor and recorded with the County Recorder. The Developer will now be able to pursue Final Plats in different phases, after all public improvement are completed.
