SUB16-1 Subdivision - Final Plat
Creekside Phase V - Final Plat
SUMMARY: The developer, Bruce Simon, is requesting Final Plat approval of 26 single-family lots as part of Phase V of the Creekside Meadows Planned Unit Development (PUD). The property is located east of S Highway 33 at Creekside Meadows Ave. The approved Preliminary Plat proposed 29 single-family lots. The total area of Phase V is 5.29-acres. The Preliminary Plat application for Phase V was approved with conditions by City Council at a public hearing during the June, 16, 2017 City Council Meeting. Subsequent Final Plat submission extension requests were approved by City Council in 2018, 2019, 2020, 2021, and 2022.
APPLICABLE PLANS & ORDINANCES: The Plan and Ordinances applicable are those which were effective at time of Preliminary Plat application in July of 2016: Driggs Comprehensive Plan adopted by Driggs Resolution 300-15, Driggs City Code Title 9, last amended by Ordinance 352-15, and Driggs Subdivision Ordinance 259-05 ("old code"). Creekside Meadows PUD Text Amendment Ordinance 418-20 is also considered.
PROJECT HISTORY: The application was received in July of 2016, therefore the application is processed under the "old" subdivision articles and guidelines of the Driggs Land Development code as described in Ordinance 259-05 (Subdivision); 278-07 (Zoning). This version of the Land Development Code was repealed on 9-29-2016 by ordinance 374-16.
The Creekside Meadows PUD was originally approved in 2001 and 4 plats have been developed to date. Phase V is on lots allocated in the PUD residential and commercial zone. The Phase V Preliminary Plat was approved by City Council on June 6, 2017 with conditions, under the previous Driggs zoning ordinance which required Final Plat recording within one year of approval (June 5, 2018). In April of 2018 the Developer submitted an application for a one-year extension in order to further review the turn lane requirements for Creekside Meadows Drive with ITD, most specifically to complete a speed study in order to appropriately design the turn lane. An extension was granted on May 1, 2018, making their deadline to submit a Final Plat application June 5, 2019. On May 22, 2019, the Developer submitted another application for one additional one-year extension, which was granted by Council on June 18, 2019, thus extending submittal of a Final Plat until June 5, 2020. On May 28, 2020 the applicant requested an additional extension as they continue to work the ITD and nearby property owners in order to address a possible reconfiguration of the intersection at South Bates Rd and Hwy 33. An extension was granted on June 2, 2020 making their deadline to submit a Final Plat application June 2, 2021. The applicant then requested another extension on May 24, 2022. The extension was approved by City Council on June 20, 2022. The applicant submitted updated materials on June 20, 2023, meeting extension deadline.
The application for Final Plat has been reviewed by the Planning & Zoning Administrator and will be considered by City Council at a public meeting during the regularly scheduled City Council meeting on May 20, 2025. City Council will make a final decision on the application.
REVIEW PROCESS: Because the application was submitted in July of 2016 the Final Plat application is processed under the City’s previous subdivision code (Ord. 259-05). Final Plats shall be prepared in accordance with Idaho Code. City Council shall consider conformance to the approved Preliminary Plat and associated conditions. In the event that the Final Plat does not substantially conform with approved Preliminary Plat, the subdivider shall be required to submit a conforming Final Plat or resubmit the plat to the Planning & Zoning Commission for Preliminary review. The final plat shall be filed with the County Recorder within six months after approval by Council, otherwise such approval shall become null and void unless an extension of time is applied for and granted.
