Land Development Code Amendments for Density Bonus Provisions
SUMMARY: This is a City initiated application proposing an ordinance amending the Land Development Code to create a new article under Chapter 14—Driggs Qualified Workforce Housing Incentive Program. The proposed ordinance would create Chapter 14 – Driggs Qualified Workforce Housing Incentive Program to establish incentives for residential developments that provide deed-restricted housing for the local workforce. The program includes:
- Density Bonus Incentive – Allowing additional residential units above base zoning in exchange for providing Qualified Workforce Housing.
- Additional Development Incentives – Including increased building height, additional lot coverage, and certain fee/requirement waivers for on-site construction of workforce housing.
- General Requirements – Standards for affordability, unit mix, quality, amenities, location, and timing of construction.
- Payment In-Lieu & Alternatives – Allowing payments to the City or alternative compliance when units are not built on-site.
- Qualified Workforce Housing Plan – Requiring submittal and approval of a compliance plan with any qualifying development application.
- Administrative Procedures – Authorizing the City to adopt program guidelines and payment calculations by resolution.
The amendment also revises Section 15.10.4 (Annexation) to require that density bonuses associated with annexations meet the new Qualified Workforce Housing requirements.

APPLICABLE CODE & ORDINANCES: Article 14.4 of the Driggs Land Development Code , last amended by Ordinance #459-23, Effective 2/15/2023; the Driggs Comprehensive Plan adopted by Resolution #379-20 on November 4, 2020.
REVIEW PROCESS: The City has initiated the proposed amendments, the amendments are considered a legislative action. The proposed amendments will reviewed for general conformance with the purpose and intent of the Land Development Code, as well as the goals and objectives of the Comprehensive Plan. During a scheduled and dually noticed public hearing on September 10, 2025 the Planning & Zoning Commission will consider making a recommendation to City Council, who will then consider the proposed amendments and ordinance during a future public hearing and will make a final decision. Upon approval by City Council, the ordinance will be executed and recorded. The Ordinance will become effective upon publication in the Teton Valley News.
