AMD26-2 Land Development Code Amendments
Short-Term Rentals
SUMMARY: Idaho House Bill 583, signed into law on March 16, 2026, prohibits cities and counties from requiring a license, fee, permit, certification or registration to operate a short-term rental, and limits requirements for short-term rentals to specific “health and safety” standards. The City of Driggs will review proposed text amendments to the City of Driggs Land Development Code in order to ensure compliance with state law by aligning City of Driggs zoning with state mandated definitions for short-term rentals (STRs) prior to the July 1, 2026 effective date. The proposed text amendments remove existing land use restrictions by re-classifying “short-term rental use” as “non-transient residential use” across all residential zoning designations, ensuring STRs are permitted in all residential zoning districts and eliminating them as a limited use. The proposed changes will modify Article 10.3.4 (Short-Term Rental) in its entirety to conform with state statute.

Review Process & Criteria: The amendments are considered a legislative action. The proposed amendments will be reviewed for general conformance with Idaho State law and the purpose and intent of the Land Development Code, as well as the goals and objectives of the Comprehensive Plan. The Planning & Zoning Commission will make a recommendation to City Council, who will then consider the proposed amendments and ordinance during a future public hearing and make a final decision.
