AP24-1 Appeal
Appeal - Sign Permit denial - Basin Building
SUMMARY: The applicant and owner, Scott Burnside, has requested to appeal a sign permit denial that occurred on October 9, 2024. The appeal was heard by the Planning & Zoning Commission at during the November 13, 2024 meeting. The denial of the sign permit was upheld unanimously by the Commission.
BACKGROUND: The applicant submitted their Design Review application on June 7, 2023. The Design Review Committee reviewed the application on May 22, 2023 and recommended approval of the application with conditions. The Planning and Zoning Commission reviewed and approved the application on June 14, 2023. A statement of decision was rendered on June 29, 2023. A sign permit application was submitted as part of the building permit application process. The building permit application was submitted July 14, 2023. The applicant was notified they would need a sign permit for any building signs in the Spring of 2024. The sign permit application was submitted August 16, 2024. The sign permit renderings show revision dates as follows: 7.3.2024 (first draft); 7.12.2024 (enlargement revisions); 7.22.2024 (changing font revisions); 8.9.2024 Correct side view and make letters 3” deep. The design review statement of decision (issued on June 29, 2023) listed no conditions associated with the approval. The Staff Report indicated the following related to sign standards:
- IV.H.1 Signs - Standards :
- See LDC Section 11.3 for all size, height, placement, and illumination standards for signs in the DX district.
- Signs, including sign faces and support structures, should complement Driggs’ natural surroundings.
- Tentative wall signs shown on elevations.
All signage shall meet sign standards in LDC 11.3, and will require a sign permit.
The sign permit SP24-1 was denied for the following reasons (included in email denial on 10/9/24):
1. Projecting signs do not meet the code, exceed maximum square footage, exceed the height requirements and do not follow the light code for illumination.
2. Proposed building (wall) signs do not meet code, exceed maximum square footage and exceed height requirements.
3. The LDC Article 11.3.1 applies to sign standards and the permit process. Wall Signs & Projecting Signs are both Permitted in the DX zone District.
