SUB07-7 Subdivision

Bear Run Subdivision

Bear Run Subdivision is a 38-lot subdivision located east of the Shoshoni Plains Phase IV subdivision. The Bear Run Subdivision was approved by City Council in 2009. At that time, the process for a subdivision was different than today and developers were permitted to record plats (creating new legal lots) prior to building the necessary infrastructure. As such, the final plat for Bear Run was recorded on March 10, 2010. A Development Agreement was also executed and recorded on October 1, 2009. However, no infrastructure was built to serve the new lots.

All of the lots remained under a single owner, who then sold the entire site to another single owner in 2023. The current owner, Bear Run LLC, intends to develop the subdivision, as entitled in 2009. To pursue the construction of required improvements (roads, water and sewer mains, utility connections), the owner was required to submit improvement plans that comply with current Public Works Standards. Additionally, the Development Agreement was updated to reflect the new ownership and the updated improvement plans.

Insignificant changes were made to the Development Agreement and are as follows: (1) update owner as party to the agreement; (2) referencing the old development agreement; (3) Removing requirements for improvements of 1000 N (nka LeGrand Pierre); (4) Clarifying the process for release of financial guarantee; (5) Updating the hours of operation for construction; (6) Removing reference to existing house on the site, as that house has been removed; (7) Added details regarding a water and sewer credit for the house that was removed.

At the regular City Council Meeting on May 7, 2024, the Driggs City Council voted unanimously to authorize the Mayor's execution of a new Development Agreement.
