Stone Peak Townhome Subdivision - Full Plat Subdivision
SUMMARY: The applicant is requesting approval of the third phase of a multi-phased townhome subdivision development – Stone Peak Townhomes - located at Hwy 33 and S. Bates Rd. The entire project totals approximately 11-acres and will contain 44 units. This phase proposes to plat 8 of the 44 lots. To date, 24 of the lots have been platted. In May 2023, the applicant was granted approval of the first phase of the final plat for 16 units. Prior to completion of the first phase, all public infrastructure was completed and accepted by the City. The parks land contribution fee-in-lieu was paid and the developer supplied the city with a warranty which guarantees all the public improvements and work against defects for a period of two years. Phase Two final plat, which platted 8 lots, was approved on January 16, 2024.
BACKGROUND: This parcel was annexed and rezoned to the NX Neighborhood Mixed Use zone and Design Review Overlay in 2021. An Annexation Agreement was signed at that time, which reflected conditions placed on the approval by City Council. Later in 2021, the owner at the time submitted a subdivision concept plan and then a Subdivision Preliminary Plat for a Townhome development. In October 2021, Council approved the Subdivision Preliminary Plat with a number of conditions. In May 2022, a new owner of the project requested that Council consider amendments to the Development Agreement, through a plat amendment process. In August 2022, Council approved amendments to the Development Agreement that would allow the developer to pursue final plats in phases. Since that time, construction of the project, in accordance with the Preliminary Plat approval, has been underway. In townhome subdivisions, the buildings must be constructed and ready to receive Certificates of Occupancy (COs) prior to recording final plat.
REVIEW PROCESS: This subdivision is considered a Full Plat Subdivision, per Art. 14.5.6 of the Land Development Code. As such, the Final Plat shall be reviewed by City Council during a public meeting. City Council should consider the approval criteria in Art. 14.5.6.K, listed below, and any relevant conditions from the Preliminary Plat approval, and consider making a final decision on the matter. Upon approval of the Final Plat staff will work to ensure that all conditions and requirements are met. At that time, the plat can be approved and recorded.
