Burnside Basin Suites (Basin Luxury Suites)


PROJECT SUMMARY: The Burnside Suite is single mixed-use building in downtown Driggs at 75 W Little. The project was approved through Design Review and Site Development, which required a review and recommendation from the Design Review Committee and a final decision by the Planning and Zoning Commission. The applicant submitted a building permit application on July 17, 2023. All residential units received Certificates of Occupancy from the Building Department as well as all commercial spaces. The developer requested approval of a condominium plat of the existing building for the 11 total units.

APPLICABLE CODE: This proposal constitutes a Condominium plat, as per Article §14.5.7 of the Driggs Land Development Code (LDC). The applicant was required to submit the Condominium plat, by-laws and CCRs in addition to the application fee for review of a condominium plat application. Nothing else was required as no development is being approved, only platting to convert single building ownership to allow for multiple ownership, all which is provided for per Idaho Statute 55-1523 and 1524.

DECISION: The City Council considered the proposal, staff analysis, and exhibits that are contained in the documents referenced in Staff Report, which serve as the public record.  The Council unanimously voted to approve the application based on the stated findings and conclusion that the proposal can meet the criteria for approval, as listed in the staff report and in Art. 14.5.7 of the Driggs Land Development Code with the following conditions: 1. All units shall receive Certificates of Occupancy before the Condominium plat can be recorded; 2. All survey edits requested by the Teton County surveyor shall be made before mylars are printed for recordation.
