Driggs Water Source Capacity Mitigation Requirements

Water Rights Mitigation Information and Application

WATER RIGHTS MITIGATION: The Water Rights & Mitigation Ordinance went into effect on July 23, 2025. The in-lieu fee of $4,000 became effective August 6, 2025. Developers and Subdividers must complete and submit the Water Mitigation Plan Application at the time of Preliminary Plat Application and/or Site Development Permit Applications . Refer to the information sheet below for information on how to transfer water rights.

A Subdivider or Developer proposing to connect to the City of Driggs water system shall offset the impact of their development on the water source capacity by conveying acceptable water rights to the City of Driggs in the minimum amount of 0.85 gpm per Equivalent Dwelling Unit (EDU) prior to obtaining a building permit or recording a final subdivision plat for such development, except that a Subdivider or Developer proposing development containing less than (25) EDUs may pay a fee in lieu of conveying water rights.

When any Subdivider or Developer proposes to mitigate their calculated water rights by conveying water rights to the City of Driggs, a Water Rights Mitigation Plan shall be submitted with the preliminary plat or site development application containing information, as requested on an approved City form, detailing the ground water right, surface water right, or canal shares proposed to be conveyed.
