AX24-3 Annexation

Live Oak Springs

SUMMARY: Live Oak Springs is an annexation proposal with a general site development plan proposing a 154.62-acre residential subdivision on two parcels (RP05N45E248000 and RP05N46E195250) located in the Driggs Area of Impact just southeast of the Driggs Airport. The proposed development includes 207 lots, consisting of 34 townhome lots, 97 detached house lots, and 76 upsized detached family lots, with 7.5 total acres of park space.

The subject property is surrounded by the Shoshoni Plains and Ski Hill Ranch Subdivisions on the southern boundary, Targhee Ranches Subdivision on the east boundary, and the Sweetwater Subdivision on the north boundary. The west boundary is adjacent to the city limits for the City of Driggs and is zoned Industrial Flex (IX) and Light Industrial (IL).

The current zoning designation for the subject property at the time of application was ADR – 0.5. The applicant is requesting an RS-7: Single-Family & Two-Family zone district if approved for annexation.

PROJECT HISTORY: The applicant is pursuing two avenues for development – 1) an annexation proposal for City zoning and subsequent development plan submission and 2) a subdivision application with the existing Area of Impact Zoning within Teton County. The AOI Subdivision Concept Plan application for the subject property was submitted to Teton County in June, 2024. The Subdivision Concept Plan application was heard at a Joint Teton County and City of Driggs Planning & Zoning Commission meeting on September 11, 2024. The item was ultimately tabled by the Commission at that hearing because the applicant had submitted additional materials for review. (see project page www.driggsidaho.org/projects/sub24-5 for more information).

The application for annexation of the subject property into the City of Driggs was received on October 25, 2024. A neighborhood meeting is a requirement of the annexation application process.

REVIEW PROCESS: A Neighborhood Meeting is required for Annexations, per Art. 14.2.2, prior to the public hearings., which occurred on February 20, 2025. Annexations are subject to Article 14.10.3 of the Driggs Land Development Code (LDC). The annexations process necessarily encompasses a Zoning Map Amendment process. The Planning & Zoning Commission (PZC) will consider the annexation and zoning designation at a public hearing, where they will make a recommendation to City Council. Following a recommendation from the PZC, City Council will hold a future public hearing to consider the item. The final decision to annex property lies with the City Council; Subsequently, the City Council makes a decision on the annexation application following a recommendation on zoning designation from the PZC. In performing an annexation application review, the commission or council may require studies of the social, economic, fiscal, and/or environmental effects of the proposed annexation.
